At Bigens, we care about your privacy. This Privacy Policy explains what personal information we collect when you visit bigens.com, buy from us, join a waitlist or contact us, how we use it, who we share it with, and the rights you have.
1. Who is responsible for your data
Bigens is a brand of Vertuem North America LLC, a Delaware limited liability company. We are responsible for (the "controller" of) the personal information described in this policy. For any privacy question or request, email hello@bigens.com.
2. Information we collect
- Order and account information: name, email address, phone number, billing and shipping address, and account details if you create an account.
- Purchase information: the products you order (including pre-orders), order history, and payment status. Your full card details are handled by our payment providers; we don't store them.
- Waitlist and newsletter sign-ups: your email address, the product whose waitlist you joined, the language and country of the site you used, and when and how you gave and confirmed your consent.
- Contact and business inquiries: what you send us through our contact form, our custom orders form or by email. That can include your name, email address, phone number, company, country, the products, quantities and customization you're interested in, your preferred delivery date, your message, and any logo or artwork files you email us.
- Return requests: the information you give us in our returns form or by email, including photos or videos of an item.
- Usage data: how you use the Site, such as the pages you visit, what you add to your cart, and when you visit.
- Technical data: IP address, device type, operating system, browser type, and approximate location derived from your IP address.
- Reviews and feedback: reviews, photos or comments you send us or post about us.
3. How we use your information
- To process, ship and support your orders, including pre-orders, returns and refunds.
- To answer your questions and business inquiries, and to prepare quotes and mock-ups for custom orders.
- To let you know when a product on your waitlist becomes available.
- To send you news and offers by email, if you agreed to receive them.
- To send service messages, such as order confirmations, shipping updates and pre-order date changes.
- To run, secure and improve the Site, and to understand how it's used.
- To measure and improve our marketing and show you relevant ads, with your consent where the law requires it.
- To invite you to review your purchase, including on third-party review platforms.
- To prevent fraud and misuse.
- To comply with legal obligations, such as tax and accounting rules.
4. Legal basis for processing (EU and UK)
If you are in the European Union or the United Kingdom, we process your personal information on these legal bases:
- Contract: to process your order and provide customer service, and to answer requests you make before ordering (for example, a quote for a custom order).
- Consent: for marketing emails, waitlist emails, and non-essential cookies. You can withdraw your consent at any time; this doesn't affect processing that happened before.
- Legitimate interests: to secure and improve the Site, prevent fraud, and answer general and business inquiries.
- Legal obligations: for example, keeping invoices for tax purposes.
5. Waitlists and marketing emails
- What you sign up for. When you join a waitlist, you agree to receive an email when that product becomes available, plus news from Bigens. When you sign up for our newsletter, you agree to receive news, tips and offers from Bigens.
- Double opt-in. After you sign up, we send you a confirmation email. We only send waitlist and marketing emails after you've clicked the confirmation link.
- Unsubscribe any time. Every marketing email has an "Unsubscribe" link. You can also email hello@bigens.com. We remove you from our marketing list right away. We'll still send you service emails about orders you've placed.
- How we send them. We send our emails with Shopify Email, part of Shopify, our store platform.
- How long we keep it. We keep your email address for marketing until you unsubscribe or ask us to delete it.
6. Contact forms and business inquiries
When you send us a message through our contact form or our custom orders form, we use the information you provide to answer you and, for business inquiries, to prepare a quote or mock-up. We don't add you to our marketing list because you sent us a message. We keep these messages as long as we need them to handle your request and any order that follows, and as long as required by law.
If you email us a logo or artwork for a custom order, we use it only to prepare your quote, mock-up and order. We share it only with the manufacturer producing your order, and we don't use it for anything else without your permission.
7. Cookies and similar technologies
We use cookies and similar technologies to:
- make the Site work, for example to keep your cart and process checkout (strictly necessary);
- remember your preferences, such as language and country;
- measure how the Site is used and how it performs (analytics);
- show you relevant ads on other websites and measure them (marketing).
We use our own tools and tools from third parties, such as analytics providers and advertising networks, for the store, for analytics and for advertising and marketing tracking. These providers may set their own cookies and collect information about your visit, for example to measure our ads and show you relevant ads on other websites.
Where the law requires it, for example in the EU and the UK, we ask for your consent before using analytics and marketing cookies, through our cookie banner or privacy choices settings. You can change your choice at any time in those settings, and you can delete cookies in your browser settings. Where the law treats advertising tracking as a "sale" or "sharing" of personal information, you can opt out in the same settings.
8. Who we share your information with
We don't sell your personal information. We only share it with:
- Shopify, our store platform, which hosts the Site, processes checkout and sends our emails;
- payment providers, such as Shopify Payments and PayPal, that process your payment securely;
- shipping carriers and fulfillment partners that store, pack and deliver your order;
- manufacturers that produce custom orders, limited to what they need for your order;
- analytics and advertising partners, as described in section 7;
- review platforms: we may invite you to review your purchase on third-party review platforms, and share your name, email address and order details with them for that purpose;
- professional advisers such as accountants and lawyers, where needed;
- authorities, if the law requires it or to protect our rights and safety.
Our service providers may only use your information to provide their services to us, and must protect it.
9. International data transfers
We are based in the United States, and our service providers may store and process your information in the United States and other countries. When we transfer personal information from the EU, the UK or other regions with transfer rules, we use appropriate safeguards, such as the European Commission's standard contractual clauses or the EU-U.S. Data Privacy Framework where a provider is certified under it.
10. Data security and retention
We use technical and organizational measures to protect your information against unauthorized access, loss or misuse. No system is 100% secure, so we can't guarantee absolute security.
We keep your information only as long as we need it for the purposes in this policy:
- Orders: as long as required for tax, accounting and legal purposes.
- Waitlist and marketing: until you unsubscribe or ask us to delete it.
- Messages and inquiries: as long as needed to handle your request and any order that follows.
- Usage data: in anonymized or aggregated form for analytics.
11. Children's privacy
Our products are bought by adults, and the Site isn't directed at children. We don't knowingly collect personal information from children under 16. If you're a parent or guardian and believe your child has given us personal information, contact us and we'll delete it.
12. Your data rights
Depending on where you live, you have some or all of these rights:
- Access: get a copy of the personal information we hold about you, including order, account and waitlist data.
- Correction: have inaccurate or incomplete information corrected.
- Deletion: have your information deleted. We may need to keep order records for tax and legal purposes, but we will remove you from marketing lists and anonymize what we can.
- Restriction: ask us to limit how we use your information while we review a request.
- Portability: receive your information in a structured, commonly used, machine-readable format.
- Objection: object to certain processing, including direct marketing and personalized ads.
- Withdraw consent: at any time, for marketing emails, waitlists and cookies.
- Complaint: lodge a complaint with your local data protection authority.
How to make a request. Email hello@bigens.com with your full name, the email address you used with us, what you'd like us to do, and any relevant order numbers. We may ask you to confirm your identity. We respond within 30 days (within one month in the EU and the UK). If your request is complex, we may extend this by up to two more months and will tell you why.
13. Third-party links
The Site may link to other websites, such as review platforms and social media. We're not responsible for their privacy practices, so please read their privacy policies before sharing information with them.
14. Changes to this policy
We may update this policy to reflect changes in our practices or the law. We'll post the new version on this page with a new "Last updated" date. If we make significant changes, we'll also tell you by email or on the Site.
